Biography

Tim focuses his trial and appellate practice on product liability, mass tort, and consumer class action defense. He serves as co-leader of the firm's Pharmaceutical and Medical Devices Class Action and Mass Tort Team. He has defended leading pharmaceutical, agricultural, automotive, medical device, and consumer product manufacturers in many of the country’s most challenging venues.

He has a proven track record of developing the facts, science, and law necessary to favorably resolve difficult litigation. He has obtained dismissal of cases through motion practice in numerous state and federal venues. 

Tim has extensive trial experience. He has first-chair trial experience in both jury and bench trials. He also has been an integral member of trial teams in high-stakes mass tort and product liability litigation, working in both evidentiary and legal issues roles in a handful of complex, multi-month trials.

His extensive appellate experience includes appeals in numerous federal and state appellate courts, including the U.S. Supreme Court, Third Circuit Court of Appeals, Seventh Circuit Court of Appeals, Eighth Circuit Court of Appeals, Tenth Circuit Court of Appeals, Illinois Supreme Court, and California Court of Appeal. 

Prior to joining BCLP, Tim served as the judicial law clerk to the Honorable Thomas D. Waterman of the Iowa Supreme Court. He received his law degree from the University of Iowa, graduating with highest distinction and as a member of the Order of the Coif.

Experience

  • Defended pharmaceutical company in consumer fraud class action concerning the sale of talc-based baby powder and obtained dismissal of the Complaint with prejudice.
  • Defended pharmaceutical company in nationwide consumer fraud class actions concerning the design, packaging, marketing, and sale of prescription glaucoma drugs and obtained dismissal of the Complaint with prejudice.
  • Represented professional hockey clubs for discovery purposes in multi-district class action litigation concerning failure to warn of long-term risks of concussions while playing hockey.   
  • Regularly defends rental car company in wrongful death, negligence, and product claims, including obtaining summary judgment in a wrongful death case in California state court.
  • Regularly defends do-it-yourself truck rental company in wrongful death, negligence, and product liability claims.  
  • Obtained reversal of intermediate appellate court ruling holding rental car company had unlimited financial responsibility for judgments entered against drivers of its vehicles under Illinois law because it self-insured its liabilities.    
  • Successfully briefed and argued issue of first impression convincing a majority of a Seventh Circuit panel that a judgment of foreclosure entered pursuant to the Illinois Mortgage Foreclosure Law was not appealable under the final judgment rule or any exception to that rule.
  • Assisted large agricultural company with post-trial motions in a case alleging that a popular herbicide caused cancer and was successful in eliminating over $211 million in punitive damages
  • Authored amici brief for leading biotechnology organizations in multi-district litigation concerning popular biologic drug
