Bryan Cave Leighton Paisner understands how universities, colleges and academic medical centers operate in a highly regulated environment that makes them among the most legally complex and challenged institutions nationwide. The multiple missions they serve – providing education, advancing knowledge through cutting-edge research, and providing the most advanced patient care available – also contribute to the sometimes-staggering legal complexity confronting higher education.

The attorneys on Bryan Cave Leighton Paisner’s Higher Education Team possess the experience, breadth and insight to solve the myriad challenges facing universities and colleges. Taking a multidisciplinary approach, we serve institutions with the following service offerings:

Bryan Cave Leighton Paisner appreciates that now, more than ever, universities and colleges find themselves under strenuous attack in the courts and from regulatory agencies across the broad spectrum of legal domains in which they operate.

The attorneys in each of these groups fully appreciate how the diverse and sometimes competing constituencies within institutions of higher education occasionally complicate management’s efforts to develop and execute legal strategies. We are skilled at assisting those efforts without making the complex dynamics of university governance and management even more challenging. We’ve “been there,” and we understand the unique discomfort that can attend higher education’s engagement with legal issues and processes, particularly in the internal investigations/compliance, technology transfer, and collegiate sports arenas.

Representative Experience

  • Represented director of critical care (and associate professor of medicine) at major university health center in federal False Claims Act investigation involving alleged Medicare overbilling.
  • Conducted independent investigation for the University of Central Florida’s Board of Trustees concerning the university’s use of restricted state funds for capital projects, including the construction of a new $38 million academic building.  After a three month investigation involving over 50 witness interviews and the review of thousands of documents, BCLP issued a written report containing its factual findings and recommendations, which the Board of Trustees made public.  This matter has received significant media attention.
