Biography

Katrin Schröder is Counsel in our Restructuring & Insolvency/Special Situations practice group in Frankfurt. She advises companies on all questions of insolvency law as well as in the area of restructuring and M&A. Moreover, she has longstanding experience in self-administration and protective shield proceedings. Her work, therefore, regularly includes advising of managing directors and executives on the continuation of the business operation, preparing of insolvency filings, drafting of insolvency plans as well as advising in M&A in distress situations.  Prior to joining BCLP, Katrin worked for a number of German and international law firms with a focus on restructuring and insolvency law.

Experience

  • Various investors in distressed M&A mandates: Advising on the acquisition of companies out of insolvency.
  • Various project developers: Advising on solutions to avoid insolvency, preparing and supporting a StaRUG (Act on the Stabilization and Restructuring Framework for Businesses) procedure.
  • Various suppliers: Advising on the enforcement of their security rights against insolvency administrators, particularly in contract and insolvency plan negotiations within the insolvency proceedings.
  • Advised pension fund and its funds on various distressed credit exposures, including the acquisition of the project company into the fund for the development and completion of the project or enforcing claims against two real estate developers through forced administration and foreclosure procedures.
  • Advised a savings bank on avoiding the insolvency of a project developer, including supporting a StaRUG procedure.
  • Advised a German airline and its subsidiaries and sister companies on various international debtor insolvencies (e.g., with airlines, suppliers, partners, and lessors).
  • Pimkie Germany: Project management for the company's restructuring through an insolvency plan procedure.
  • Orsay GmbH: General representative in a protective shield procedure with an investor process and subsequent value-maximizing liquidation of the group under insolvency conditions, including partial sale of foreign subsidiaries.
  • *Project management for the restructuring of a system catering group with an investor process.
  • *Ongoing crisis consulting for several internationally active fashion and retail companies.
  • *Project management in a number of self-administration and insolvency plan procedures.
